Order, payment, sourcing, shipping and customer responsibilities

These terms are designed to sit behind the Terms & Conditions link on Aswaqi's website and to be accepted before a customer completes a paid order.
Checkout acceptance: I confirm that I have reviewed my order details and agree to Aswaqi's Terms & Conditions, Refund & Returns Policy, Shipping & Delivery information, and Privacy Policy.
The customer is responsible for reviewing product names, variants, sizes, colors, quantities, specifications, delivery details, contact information and all other order instructions before payment. Aswaqi is not responsible for losses, additional costs or delays caused by incorrect or incomplete information supplied or approved by the customer. Changes requested after confirmation are not guaranteed once purchasing, production, consolidation or shipping has begun.
Payment is treated as the customer's confirmation to proceed. Because Aswaqi may immediately purchase, reserve, produce or arrange goods, a paid order generally cannot be cancelled merely because the customer changes their mind. Any exception must be expressly approved by Aswaqi and remains subject to applicable law and the Refund & Returns Policy.
Products may be sourced from third-party manufacturers, suppliers or sellers. Availability and supplier lead times may change. If a paid item becomes genuinely unavailable, Aswaqi may arrange an appropriate replacement, credit or refund for the affected item, depending on the circumstances. This does not automatically cancel unaffected items.
Certain products, including food products and specially produced goods, may require manufacturing, preparation or supplier processing before dispatch. Production time is separate from shipping time. Aswaqi does not guarantee a specific manufacturing date or remaining shelf-life period unless that requirement was expressly accepted in writing before purchase.
Product images are intended to represent goods reasonably accurately. Lighting, screens, photography, manufacturing batches and materials can create minor differences in color, finish, texture, packaging or appearance. Minor variations that do not materially change the ordered product are not by themselves grounds for cancellation, return or refund, to the extent permitted by law.
Any delivery or transit timeframe is an estimate unless expressly guaranteed in writing. Shipping time begins after the shipment is ready and handed to the carrier and does not include sourcing, manufacturing, preparation or consolidation. Carrier schedules, customs, inspections, congestion, weather, public authorities and other external circumstances may cause delays.
Goods may be handled by independent freight forwarders, airlines, shipping lines, couriers and warehouses. Aswaqi is not responsible for damage, breakage, loss, mishandling or delay caused by an independent carrier or events outside Aswaqi's reasonable control, except where applicable law provides otherwise or the loss results from Aswaqi's own legally established responsibility. Aswaqi may reasonably assist with available carrier or insurance claims.
If Aswaqi itself fails to purchase or include a paid item, or purchases a materially different item because of a verified Aswaqi error, the customer should notify Aswaqi promptly with reasonable evidence. After verification, Aswaqi may source and send the correct item, provide a credit, or refund the amount attributable to the affected item.
Product payment does not automatically include every freight, customs, local-delivery or door-to-door charge unless expressly stated in the quotation or checkout. Where an additional shipping or delivery balance is due, Aswaqi is not required to arrange or complete that transportation stage until the required amount is paid.
Unless expressly included, customs duties, taxes, inspection charges, permits and other governmental charges are the customer's responsibility. Customs and government procedures may cause delays outside Aswaqi's control. Customers are responsible for ensuring goods can legally be imported or used at destination unless Aswaqi expressly agrees to provide that compliance service.
Aswaqi is not responsible for delay or failure caused by circumstances outside its reasonable control, including severe weather, natural disasters, war, civil disturbance, strikes, port or airport disruption, carrier cancellation, government restrictions, customs action, epidemics, system outages or supplier shutdowns.
To the fullest extent permitted by applicable law, Aswaqi will not be liable for indirect, incidental, special or consequential losses, including lost profit or business opportunity, arising from customer errors or third parties outside Aswaqi's reasonable control. Nothing in these terms excludes liability that cannot legally be excluded.
Orders are subject to the separate Refund & Returns Policy. In general, a completed and paid order is not refundable or returnable merely because the customer changes their mind. Verified Aswaqi errors, unavailable paid items and mandatory legal rights are handled under that policy. Please review the Refund & Returns Policy before payment.
The policy version presented at checkout applies to that order unless a change is required by law or expressly agreed. Aswaqi may update its terms for future orders.
